The Ninth Circuit Court of Appeals reaffirmed the district court's decision in Comité de Jornaleros de Redondo Beach v. City of Redondo Beach that struck down the City of Redondo Beach's anti-solicitation ordinance as a "facially unconstitutional restriction on speech."
The court cited the “well-established principles of First Amendment law,” and the court concluded that the city’s “Ordinance fails to satisfy the narrow tailoring element of the Supreme Court's time, place and manner test.”
“Today's decision sets a strong precedent [for] day laborer rights and stands as one in a line of successful cases brought by MALDEF on behalf of the rights of day laborers in the Ninth Circuit over the last dozen years,” a Mexican American Legal Defense and Educational Fund (MALDEF) statement read.
“Today's en banc Ninth Circuit opinion resoundingly vindicates the First Amendment rights of day laborers throughout the western United States,” Thomas Saenz, MALDEF President and General Counsel said. “Dozens of similar ordinances throughout the region that purport to prevent day laborers from speaking on sidewalks are now even more plainly violative of the Constitution. Each municipality with such an ordinance should immediately suspend and repeal its law. The longstanding principle that the right of free speech belongs to everyone has been significantly bolstered by this decision.”

The Executive Director of National Day Laborer Organizing Network (NDLON), Pablo Alvarado, also commented on today’s decision.
“Today’s decision is an outcome of a struggle in the courts and in the streets that began in the early 90's. The ordinances were intended to render day laborers invisible; but the struggle against these ordinances has made day laborers more visible, more powerful.”
The decision overturned a 2-1 panel ruling.

San Diego County votes to implement E-Verify
The San Diego County Board of Supervisors took one step away from sanctuary-city leanings today and adopted the use of E-Verify for all new hires.
Chairman Bill Horn and Supervisor Dianne Jacob, who introduced the new county regulation, garnered enough support from other County Supervisors to implement the federal Electronic Employment Eligibility Verification System (E-Verify) for all new County employees.
The federal government computer system, E-Verify, is assessable online and determines if prospective employees are legally able to work in the U.S.
DHS champions the E-Verify program that is used by both private and public sectors with a 96.8 accuracy rate.
“This is a positive step for the County, especially in tough economic times,” San Diego County Supervisor and Chairman Horn explained. "E-Verify is a way to help ensure that jobs are only going to those who can legally be employed and protect businesses and eligible job-seekers, all at no cost to the County. I would like to see if this can be used to require county contractors to implement the program.”

The County of San Diego will start the implementation process by signing a Memorandum of Understanding (MOU) with the Department of Homeland Security (DHS) establishing the city’s new E-Verify requirement.
“I’m optimistic that this important step will preserve jobs for legally-eligible workers by upgrading to a system superior to the one the county currently uses,” said Supervisor Jacob. “I will be tracking the effectiveness of E-verify to see whether wider use will help turn off the jobs magnet that encourages illegal immigration.”
The federal E-Verify program compares information provided by a prospective employee, like Green Cards or Social Security numbers, to DHS and Social Security Administration records that keep track of employment status. San Diego will begin using E-Verify on October 21, 2011.

Escondido Police fight to stay competitive during pay negotiations
When it comes to law enforcement, the Escondido Police Department tends to lead California regarding rule-of-law policies. Police Chief Jim Maher prides himself on enforcing immigration and traffic safety laws on the books-sometimes to the chagrin of illegal-immigration activists. So when the issue of officer salaries boiled to the surface, the Chief knew negotiations wouldn’t be easy.
The Escondido Police Department (EPD) union leaders knew their salary negotiations would center on campaign promises made by the new Mayor Sam Abed. During the Mayor’s hotly contested political race, he informed voters he would reform employee unions to save the city money.
According to Police Department Union officials, the city’s police department salaries are the lowest in the county and risk turning the nationally acclaimed police department into a training ground for other cities that offer much higher wages.
“Each police officer trainee costs the city more than $100,000 to train. Once a rookie finishes the academy a veteran officer must then patrol with the recruit for a year,” said Frank Huston, Escondido Police Officer and head of the department’s union.

“Right now we are in a waiting pattern with city Mayor Abed regarding our salaries,” Huston explained. “I’m concerned; really concerned we are on the verge of becoming a training ground for other police departments.”
A similar policy in San Diego resulted in the loss of dozens of officers who chose to move laterally to better paying police departments once they finished their training. The city of San Diego is a top 10 metropolitan city and a SDPD Police officer resigns every six days.
In an effort to avoid the same fate, the Escondido Police Chief sent a memo to the City Council regarding a pay freeze that points out the north county city is dead last when it comes to police officer compensation.
The memo encourages the city to restore six officer positions (to keep up with the growing population), create a second tier retirement plan and have the police department employees contribute nine percent to offset pensions.
“We’ve made concessions in the past to accommodate the city council’s needs,” Huston said. “Now it’s time for the city to work with its officers.” He continues to explain that many EPD dispatchers make more than beat officers with three to five-years of experience.
The memo continues to highlight that EPD is aware of at least 13 veteran officers seeking employment at other higher-paying police departments. And, on average, these lateral transfers will put an additional $12,000 per year into officers’ bank accounts. The memo also indicates that police officers do not retire with six-figure salaries, but closer to $75,000 after 30 years of service (which is the exception not the rule).
While many cities in Southern California see crime statistics rise, Huston says EPD’s crime number has gone down under the leadership of Chief Maher.
The Chief continues to pursue and receive grants from the state of California to hold sobriety and traffic safety checkpoints every-other weekend. Despite protests from open border activists, the Escondido checkpoints have garnered national attention.
“We were recently nominated by MADD for a national safety checkpoint award,” said Lt. Tom Albergo, a 28 year veteran of the Traffic Division.
The National Highway Traffic Safety Administration (NHTSA) picked the Escondido Police Department after they sent a representative from the east coast to monitor the every-other-weekend sobriety/driver’s license checkpoint.
“There are only six police departments in the country up for the award and our officers’ hard work has paid off,” Albergo explained. “Since we started implementing the checkpoints, our traffic accident statistics have steadily decreased.”
A sampling of results showed that EPD’s 2005 hit and runs fell from 660 to 428; all accidents fell 1,632 to 1104; DUI injury accidents fell 152 to 87 and total traffic injuries fell 1,399 to 898. Overall the city of Escondido has lowered various crimes.
While residents enjoy the benefits of a safer community, (crime is down 24 percent from last year) the Escondido Police Department just wants the city council to honor contracts both parties have agreed to and unfreeze the step raises. “I know it’s popular to disparage unions right now,” Huston said. “We’ve all seen the Wisconsin problems, but I just ask the city to recognize our work is labor-intensive and dangerous. Our officers have worked hard to bring down the overall crime rates, and they deserve to have salaries comparable to neighboring cities.”
Huston also points out those officers don’t get Social Security (even though they pay into it) “and the union has agreed to make concessions with new hires. We just want the city to honor our previous agreements.”
When looking for answers to the city’s hard line on police contracts, some officers within the Escondido Police Department contend that the “by-the-book” enforcement of illegal aliens that make up a large chunk of the city’s 147,000 population (approximately 40 percent are Hispanic) is a key reason why the department is being held to the lowest pay scale in the county.
Recently Escondido Mayor Abed told the North County Times that “it might be wise to exempt companies (from E-Verify) that do only occasional business with the city.”
Escondido became the first city in San Diego County requiring private contractors run employees through E-Verify to ensure no illegal aliens were on the payroll. But, issues arose when city staff forgot to include the E-Verify provision in its annual contracts valued under $25,000.
"We'd like to require E-verify for all companies doing business with the city, but we have to make sure it doesn't create a bloated bureaucracy and some problems for us," Abed said. "The key is making sure we include companies that regularly do business with the city."
Escondido Councilwoman Olga Diaz, who voted against the city’s requirement to mandate E-Verify and does not like the EPD sobriety checkpoints, explained the divisive E-Verify policy stance is nothing more than showmanship. "It's a complete waste of time to even bring this up because this policy is not being enforced," Diaz told the Times regarding the city's E-Verify honor-system program. "Adopting the policy was a symbolic move that was all about chest-puffing, and I don't think we ever need to talk about it again."
Setting all the politics aside, one EPD detective pointed to the police department’s policy of “doing what it takes to get the job done” as a benefit for working with Chief Maher. “It’s why we have a top-notch department year after year.”

Congress moves closer to implementing E-Verify for government new hires
Congress voted today for an amendment that would restrict any federal agency funded by the 2012 Energy and Water Appropriations bill to hire an employee without using the federal government’s E-Verify program.
House legislation, H.R. 2354, adopted the E-Verify amendment in the full Appropriations Committee. However activists promise it will find more scrutiny as it works its way through the full legislative process.
“With 9.2 percent of Americans out of work, I am pleased to see the E-Verify language approved by my colleagues in the House,” Rep. Alan Nunnelee (R-MISS) said about his amendment. “Over 22 million Americans search for work on a daily basis, while research estimates that over 7 million U.S. jobs are held by illegal aliens. This is a common-sense amendment that simply uses the appropriations process to enforce the E-Verify system that is currently in place.”

Currently the E-Verify Program is a voluntary program that enables employers to verify the name, Social Security Number and alien identification number (for non-citizens) for employment. E-Verify boasts of a 96 percent accuracy rate, but dissenters argue it’s the remaining 4 percent that warrants employers not to participate with the government program.
“Illegal employment is a contributing factor to our nation’s current debt problem. In these harsh economic times, it is important to make sure illegal aliens are not in the workforce. U.S. jobs should go to legal workers,” Nunnelee finished.

D.C. lawmakers move to implement E-Verify for some government contracts
In an effort to protect American jobs, the U.S. Congress adopted an amendment to the FY 2012 Energy and Water Appropriations Bill that mandates the government hold contractors accountable by using the E-Verify program.
The Amendment was successfully introduced by Congressman Alan Nunnelee (R-Miss). “This is a common-sense amendment that simply uses the appropriations process to enforce the E-Verify system that is currently in place. While nearly 14 million Americans are looking for work, research estimates that more than 7 million illegal aliens hold jobs in the U.S. workforce.”
Rep. Nunnlee says the Amendment will help eliminate illegal employment that is costing U.S citizens jobs and money.
“Illegal employment is one of the driving forces of illegal immigration and a contributing factor to our nation’s current debt problem. Illegal immigrants use our medical services, draw on state and federal assistance and take advantage of our educational system for their children – all at the cost of hardworking taxpayers,” Nunnlee said. “As a member of the Immigration Reform Caucus, I am committed to identifying legislative solutions that address the issue of illegal immigration. Similar E-Verify language has been included in the Homeland Security bill, and this amendment is a step in the right direction.”
E-Verify is an Internet-based system that allows an employer, using information reported on an employee's Form I-9, Employment Eligibility Verification, to determine the eligibility of that employee to work in the United States, according to DHS's website.

The easy to use, web-based, E-Verify program is a free verification service offered by DHS and the Social Security Administration. While the program is voluntary for most employers, those seeking certain government contracts must enroll their future employees. The process is straightforward and takes less than a minute per identification and is 96.9 percent accurate.
To date more than 238,000 employers are enrolled in E-Verify, with more than 16 million queries run through the system in 2010. So far this year there have been more than three million cases run through the system.

Supreme Court rules in Arizona’s favor – E-Verify to be implemented statewide
The state of Arizona finally caught a break; the Supreme Court ruled in favor of the state’s ability to require employers to use the federal E-Verify program. The decision also allows the state to revoke business licenses of companies that knowingly hire illegal workers.
The E-Verify program is a successful federal program that uses Social Security card numbers to ensure prospective employees are able to legally work inside the United States. Proponents of E-Verify would like to see this program used by all businesses in the country and say it would curtail illegal aliens from crossing the porous southern borders because they would no longer be able to get a job.

When it comes to moving forward and dealing with the large illegal alien population currently residing in the country, lawmakers say turning off the ability for illegals to get a job needs to be at the top of the “honey do” list.

The E-Verify program is a successful federal program that uses Social Security card numbers to ensure prospective employees are able to legally work inside the United States. Proponents of E-Verify would like to see this program used by all businesses in the country and say it would curtail illegal aliens from crossing the porous southern borders because they would no longer be able to get a job.

Fantastic news Obama’s immigration speech says the border fence is finished
President Obama stood before thousands of Texas Democrats and La Raza (The Race) supporters and told a whopper of a lie- “They (GOP) wanted a fence. Well, that fence is now basically complete.”
This is welcome news for those who live near the 2,000-mile southern border; unfortunately it is another propaganda-type lie.
Let’s educate Mr. Obama regarding what exactly is a fence. According to Webster’s Dictionary, a fence is a barrier that serves to enclose an area; an inclosing structure of wood, iron, or other material, intended to prevent intrusion.
Keeping this in mind, the President’s claim that the fence is “basically complete” is untrue. A Government Accountability Office (GAO) February 2011 report says Border Patrol does not control the border. In fact Border Patrol only has the ability to control or prevent illegal entry for 129 miles of the 1,954-miles of U.S./Mexico shared border.
To date the GAO report concluded that Homeland Security has only built 646 miles of border fence. Of this very little was the “two layers of reinforced fencing” that was required by the Secure Border Act. Also included in this secure fence number was 347 miles of pedestrian fencing as well as 299 miles of vehicle barriers.
"Pedestrian fencing is designed to prevent people on foot from crossing the border and vehicle fencing consists of physical barriers meant to stop the entry of vehicles," said Richard Stana, director of homeland security for GAO.
In March, Stana told the committee that Homeland Security had only improved the total length of border fence by three miles last year.
The GAO goes on to reveal that an additional 744 miles of border region gives the Border Patrol power to stop an illegal entry at "distances of up to 100 miles or more away from the immediate border."
Add those numbers up and that leaves 1,081-miles of America’s southern border open and means Homeland Security has no "operational control" along much of the border.
That doesn’t sound secure.
The president also alluded to the fact that border cities are the safest cities in all of America.
Lie number two.
Looking at an annual statistical report put out by the Executive Office for the United States published in 2010 highlighted the violence on the border.
"The violence along the border of the United States and Mexico has increased dramatically during recent years and the violence associated with Mexican drug trafficking organizations pose(s) a serious problem for law enforcement," the report indicated.
It continues to describe that "Illegal immigration provides the initial foothold with which criminal elements, including organized crime syndicates, use to engage in a myriad of illicit activities ranging from immigration document fraud and migrant smuggling to human trafficking. Federal prosecution of border crime is a critical part of our Nation's defense and federal jurisdiction over these offenses is exclusive."
Even President Obama's own Justice Department, says there were more than two-and-a-half-times as many criminals (8,435) charged in federal court in Western Texas, coincidentally El Paso is located in this sector, than in the combined districts of Southern New York (1,959), which includes Manhattan and the Bronx, and the Eastern New York (1,377), which includes Staten Island, Brooklyn, Queens and Long Island, according to CNSNews.
There are other issues and expenses attached to the mass amnesty President Obama is recommending.

“An amnesty would cost taxpayers millions, if not billions of dollars—at a time where debt is at its ceiling and budgets are busted. It would also reward those who broke the law and came to the U.S. illegally over those who came to the U.S. the legal way,” explained Jena McNeil of The Heritage Foundation.
“Winning Hispanic votes is his (Obama’s) end game,” Israel Ortega says. “It's obvious that political calculations are driving the President's push for immigration reform in light of his all-time-low support among Hispanics. President Obama's advisors remain convinced that immigration reform will guarantee their support, despite polling that indicates that unemployment and education are issues that keep most Hispanics up at night.”
Congressman Brian Bilbray (R-CA) who represents a San Diego community directly affected by illegal immigration thought Obama’s speech was overly optimistic.
“The President provided plenty of good examples for success stories of legal immigrants in his campaign speech. But exploiting their success stories as justification for amnesty to an estimated 11-20 million illegal immigrants who have violated our nation’s laws and cut in line is completely irresponsible,” Bilbray said. "While the crime rate and number of illegal crossings along the border is down, the federal government has still not done enough to address the source of the problem – employers who use illegal labor.”
Congressman Bilbray along with many immigration-minded lawmakers also favor a nationwide implementation of E-Verify to ensure all employers play by the rules and hire only those legally able to work in the U.S.
“The President mentioned holding employers accountable for hiring illegal workers but he has yet to join me in the call for nationwide implementation of the E-Verify system. I call on President Obama to join with members of the House Immigration Reform Caucus to implement a nationwide E-Verify program to hold employers accountable,” Chairman of the House Immigration Reform Caucus finished.
Meanwhile, south of the border in Mexico the warring drug cartels continue to step up their brutal murderous ways; this week in Durango, Mexico six human heads were left at the entrance of a secondary school forcing classes to be cancelled because the scene was too gruesome. Authorities conducted an extensive search for the bodies without any success; unfortunately these gruesome scenes are the rule- not the exception.
With scenes like this playing out around the savaged Mexican country, it’s not hard to understand that Mexicans’ want to run the border and grab a better and safer life, but none of the proposals included in President Obama’s comprehensive immigration reform plan addresses the rush of illegal aliens leaving Mexico and other Central American countries.
If America moves forward with an immigration reform plan without addressing the drug cartels and massive corruption in the Mexican government, it will only be a matter of time before the second and third wave will head north looking for that “better life” courtesy of the American taxpayer.

Want to practice your illegal alien smuggling skills? There’s an app for that
A new iPhone/iPad app is set to be released next month. This new controversial game is called “Smuggle Truck- Operation Immigration,” and it allows gamers to fill their truck with as many illegal “immigrants” as they can and race across the desert landscape into America.
“Smuggle Truck was inspired by the frustration our friends have experienced in trying to immigrate to the United States. With such a troublesome issue being largely avoided in popular media, especially video games, we felt the best way to criticize it was with an interactive satire,” said app creators Owlchemy Labs.
“This idea originated as a result of learning that the process of legal immigration was not as straightforward as we had assumed,” the game designer said. “As we lived through a painful 12 months of our friend struggling through the absurd legal minefield that surrounds U.S. immigration, we felt that we should create a game that touches on the issue.”
The satirical game came about after immigration discussions sparked a very real concern. "It's so tough to legally immigrate to the U.S., it's almost easier to smuggle yourself over the border."
The game’s goal is to load up a truck with passengers and quickly speed across a fictional border. Drive too fast up-and-down the hillsides and your “immigrants” will fall off of the truck and reduce your illegal alien tally.
The game’s designers claimed that they kept a “meticulous eye (in order) to avoid depicting stereotypes and specific locales. Through user testing and feedback from fellow developers and random strangers, we worked to represent the game in a more abstracted form.”
Owlchemy Labs hopes the fictional, satirical game will spark attention to America’s very real immigration issues.

Anchor babies cost Los Angeles welfare $600 million last year
California harbors the most illegal aliens in the nation and a new report out from the Los County Board of Supervisors shows the incredibly high cost of welfare for parents of anchor babies.
The $600 million tab was tallied using county statistics released by Los Angeles County Supervisor Michael Antonovich who says social spending for those families rose $53 million in November and when added to the $570 already spent would edge the yearly welfare bill past $600 million for 2010.
Antonovich estimated the figure using the cost of food stamps and other welfare benefits used by California’s CalWORKS program. The supervisor also pooled those numbers with public safety and health care costs.
However, county officials say the "total cost for illegal immigrants to county taxpayers is $1.6 billion,” according to a Fox News report.
The report does not include the hundreds of millions the state and county pay for educating illegal aliens as mandated by federal law.
Supervisor Antonovich recognizes the (anchor baby) kids he focused on are U.S.-born, but the money collected from welfare is given to their parents who are primarily illegal aliens.
"The problem is illegal immigration. ... Their parents evidently immigrated here in order to get on social services," Antonovich spokesman Tony Bell told Fox News. "We can no longer afford to be HMO to the world."
Those welfare numbers are similar to a report by the Federation for American Immigration Reform, a Washington D.C. think tank seeking a solution for the out-of-control immigration problem in America.
FAIR contends many states’ budget crisis can be tied directly to illegal aliens residing in their district and collecting a bevy of social-services money.
Last year FAIR estimated the yearly total for America’s illegal immigration stood at $113 billion and California’s cost was nearly $22 billion.

La Raza targets lawmakers who voted against the DREAM Act
The National Council of La Raza (NCLA) announced it will begin a new ad campaign targeting those lawmakers who voted against the DREAM Act (Development, Relief, and Education of Alien Minors) during last year’s lame duck Congressional session.
La Raza (the race in Spanish) launched an online and print ad campaign named “We Will Not Forget.”
The campaign will serve as a reminder to voters that Congress members of both parties voted against the DREAM Act and Latino organizations were watching.
The ads will be running in Spanish-language newspapers in some states as well as select online websites in both English and Spanish.
The big red poster is downloadable and includes the pictures of all lawmakers who did not support illegal aliens’ children’s right to amnesty and qualify them for in-state college tuition. La Raza hopes supporters will download the poster and put it on their refrigerator to serve as a daily reminder.
“As we move into the new Congress and work toward advancing important legislation for our community, it’s crucial not to forget what happened in the lame duck session of 2010,” said Laura Vazquez of La Raza. “The ‘DREAM Act’ was an important measure of support for our community and we need to remember who stood with us and who turned their backs on us.”

Want a false Social Security card? There’s a blog for that
"Only in America" part one...
Did the DREAM Act not go your way? Are you looking to skirt the law? Then head to the DREAM Act Portal. DAP is an immigration advocacy website that not only encourages political activism, but the forum actually details how to get a fraudulent Social Security card.
But that’s not all they also dole out advice regarding employers who won’t look at the actual Social Security card and where to buy a fake one in Los Angeles.
Now that the DREAM Act is dead, those in the country illegally are busy assisting others with the do’s and don’ts of job hunting without a real Social Security card.

If you have a SSN, even if it says "not valid for work", just simply transfer that number to clean card. You just need to know the right people to get a clean card. Besides that, you can just simply show your high school ID or passport, as a second ID. But, make your passport as the very last option.
Second: stay away from large chain-stores. Usually those stores follow a stricter hiring procedure in hiring people, they literally do background checks on you before hiring you. Try to find a place that is privately owned, like restaurants, family- run businesses; they are usually lenient in hiring people.
Also, try to stay away from places that have lots of immigrant (illegal) workers. Usually there's snitches around that hate on immigrants and just call ICE to raid the place.

Judge rules illegal aliens can collect workers compensation
Straight out of kangaroo court, a D.C. Court of Appeals judge ruled that illegal alien, Palemon Gonzales, is eligible to receive about $11,000 in worker's compensation benefits.
The employer at the time, David Karim claims he knew nothing about the employee's legal status as he used his cousin, Armando Casarrubias' green card to obtain a busboy job.
The illegal alien's identity came to light after he was injured on the job by a flying beer bottle that sent him to the hospital.
The aptly named bar, Asylum, found out their employee was using falsified documents to work once the hospital began sending medical bills in his real name.
The bar owner, Karim, testified at the workers' compensation hearing saying Gonzales snookered him and presented false documents to acquire employment at his bar.
Once management found out the illegal alien provided false documents they promptly fired him, but this action led to the courtroom where the workers' compensation board gave Gonzales his benefits.
The D.C. Appeals Court said it is legal under the District's workers compensation laws to provide benefits to any employee regardless to legal status. The court claimed it is "consistent with the principle that the (workers' compensation act) is to be construed liberally to achieve its humanitarian purpose."
The court suggested the opposite decision could lead to employers reneging on their responsibility to protect workers. By paying workers compensation for illegal immigrants the court stated it would avoid a "powerful incentive for employers not to hire such individuals."
However, anti-illegal immigration advocates see things differently.
"The court noted that it was trying to send a message to those who would employ illegal aliens- putting them on notice that they must not treat employees unfairly," said Michael Cutler former INS agent and immigration expert who has testified before Congress numerous times. "I certainly agree that we must do all that we can to discourage the employment of illegal aliens by employers- however, what about the message that this decision sends to illegal aliens and foreign nationals who may, at this moment, be contemplating running our nation's borders and seeking illegal employment?"
Cutler contends this case is reminiscent of the President and members of Congress who said they wanted to put illegal aliens on a pathway to United States citizenship. "The idea is that if your violate our borders, violate our immigration laws and likely other laws along the way, we will not only let you get away with these violations- we want to reward you for those violations."
In essence, comprehensive immigration reform and other forms of amnesty send precisely the wrong message to the illegal aliens as does this Appeals Court decision, according to Cutler.
"There is nothing in the decision that deters or dissuades aliens from running our borders and working illegally- quite to the contrary, the court decision will likely be seen as an additional inducement for aliens to ignore our borders and our immigration laws while the Court claims the point was to discourage employers from intentionally hiring illegal aliens," he finished.

San Diego businesses turn to ICE IMAGE program to ensure legal employees
A little known employment verification program run by ICE (Immigrations and Customs Enforcement) is spreading throughout San Diego County and the country. IMAGE (ICE Mutual Agreement between Government and Employers) is a relatively new tool for employers in the fight against illegal immigration.
While the E-Verify program is widely known and now used by hundreds of thousands of businesses nationwide to check their employee's legal eligibility, the IMAGE program goes far beyond fast and easy computer background checks. The IMAGE program ensures that businesses use Homeland Security's 'best hiring practices' to help detect fraudulent documents through education and training.
The IMAGE certification process gives business owners the peace of mind their current employees are legal and customers can see an IMAGE certification sticker in the window (similar to the Better Business Bureau-BBB) to show that the business is complying with all Federal laws.
“IMAGE is a win-win partnership between ICE and the business community,” said Miguel Unzueta, special agent in charge for ICE’s Homeland Security Investigations (HSI) in San Diego. “The training and education employers enrolled in the IMAGE program receive gives them the tools they need to develop a more secure and stable workforce. And beyond that, each time a new company voluntarily signs up as an IMAGE participant, we are better able to protect lawful workers in this challenging economy.”
The IMAGE program is a free service operated by ICE and takes 4-6 weeks to complete. During the process, the ICE agent makes several visits to the business to conduct on-site training and inspection of the I-9 hiring documents.
Earlier this month, UNICEL Corporation in Escondido, CA became the first business in that city, known nationwide for its strong stance against illegal immigration, to be IMAGE certified.
UNICEL owner Mike Henderson says he was glad to take an active role in combating the number one draw of illegal aliens to the country.
“We are pleased to be IMAGE certified. We learned a lot about what legal documents look like and now feel confident as a business,” Henderson said. “The process was painless, enjoyable and now we will avoid any fines because we have the correct paperwork.”
At the ceremony last week was newly elected Escondido Mayor Sam Abed, who is also a legal immigrant. “I am proud that UNICEL went through the program and it reassures city residents that Escondido businesses are doing everything in their power to have a legal workforce.”
ICE Special Agent John Murakami, who conducts IMAGE audits and certifications for San Diego County, attended the ceremony and presented UNICEL with their IMAGE certificate. Agent Murakami said he enjoys this aspect of the job.
Also attending the ceremony was Jim Betz, owner of Betz Concrete which is also located in Escondido. His cement business is nearing completion of their ICE audit and they hope to have their IMAGE certification by the first of the year.
“I sleep well at night knowing I am hiring American workers in this tough economy,” Betz said about the IMAGE program. “It’s definitely worth it to get the paperwork in order. Before IMAGE I didn’t know what to look for when employees provided me with I-9s.”
Currently San Diego County has six businesses that are fully IMAGE certified and according to ICE several more are in the pipeline.
Local secure borders activist Jeff Schwilk hopes more businesses will see the many benefits of being IMAGE certified and sign up with ICE. “IMAGE is a powerful tool for businesses who want to follow the law and hire only American and legal workers,” he said. “IMAGE certification tells the public this business has gone above and beyond in their hiring practices and can be fully trusted. It also gives them a leg up on their competition which is so important in this recession and period of high unemployment.

Chipotle and McDonald’s crackdown on illegal employees
In an attempt to comply with the U.S. immigration law restaurants across the country are double checking their employee’s paperwork to ensure they are eligible to work in the country.
Chipotle, a Mexican food chain in Minnesota fired approximately 50 Latino employees last week who failed to comply with an I-9 audit and provide adequate documentation showing they could legally work in the United States.
The number of restaurants working in coordination with Immigration and Customs Enforcement (ICE) has increased as the Obama Administration is cracking down on businesses looking to skirt the immigration rules of employees.
However, the decision to fire 50 Latino employees didn’t sit well with Minnesota Immigration Rights Action Committee (MIRAC), who is fighting the restaurants’ decision and claims that Chipotle unfairly targeted the Hispanic workers.
“We started to piece together there was something larger going on than a few people fired at one store,” said MIRAC affiliate Brad Sigal. “It appears to be a statewide attack on immigrant workers who are longtime employees most of them been working there for years.”
Meanwhile the Chipotle restaurant chain was subjected to an I-9 audit in which ICE requests employers to collect paperwork from staff and verify their legal status.
“They check the paperwork and fire anyone who can’t immediately prove they have the right to work. An action like this on a mass scale before the holidays is not consistent with the image they (ICE) have cultivated,” Sigal said.
Chipotle restaurant released a statement that read in part, “We are fully cooperating with Immigration and Customs Enforcement officials in Minnesota in connection with a document request they have made.”
Other restaurants, like McDonalds or Sizzler are also ensuring their employees legal status by requesting documentation for the federal government program E-verify. The program takes only a few minutes to complete and provides employers with the legal status of their prospective employees.
The E-verify program is a free service and has more than a 95 percent accuracy rating. Once businesses complies with the employment check, many are placing the E-verify signs provided by ICE in their business windows like the McDonalds in Sedona, Arizona pictured above.

Oakland to issue illegal immigrants an identification card
The liberal, albeit much poorer suburb of San Francisco is making a strong effort to issue identification cards for those in the country illegally, the card will also double as an ATM.
According to city officials, the ID card would assist illegal aliens who have a tough time obtaining proper identification. The city contracted out the ID card service to a private company who will present their plan and start issuing state IDs at no cost to the city of Oakland.
The city council claims the new program will help residents, including those in the country illegally, get documentation to prove their identity. The cards would be valid to use wherever other state ID is required.
In an interesting twist the Oakland ID card would also double as an ATM card. The purpose of this addition to give illegal aliens the ability to use the card and avoid the use of “payday or check cashing” services that often charge very high fees.
“This will probably be the most advanced municipal ID in the country,” explained Mayor-elect Jean Quan.
Oakland councilwoman Nancy Nadel added that “we wanted to make sure that it’s not just another way of identifying people who don’t have documentation.”
Oakland will now join cities like San Francisco and Washington D.C. in offering more incentive for illegal immigrants to continue to enter the country illegally and skirt America’s overly burdened immigration process.

Employers who hired illegals fined, may get jail time
A Southern California man who owns and operates a furniture manufacturing plant was arrested and charged with hiring illegal aliens this week.
The Orange County man, Rick Vartanian, who is the primary shareholder in the Rancho Cucamonga Brownwood Furniture company is accused and charged with criminal information with obstruction of justice and a misdemeanor count of continuing to employ unauthorized employees.
Immigration and Customs Enforcement says “Vartanian told investigators that unauthorized workers identified during an earlier immigration audit were no longer employed by the company, when, in fact, the firm continued to employ 18 of those workers and had taken steps to shield them from detection.”
As a result ICE agents executed a search warrant at the furniture manufacturing plant in December and found the 18 illegal immigrant employees still working.
The owner, Vartanian has already agreed to a $10,000 fine and will face a maximum of 66 months in federal prison for defying the orders from ICE in December.
However, Vartanian is not alone in facing law enforcement charges. Just three weeks ago Brownwood Furniture’s Vice President Michael Eberly was served with legal documents for his role in keeping illegal aliens on the payroll.
He faces criminal information charges with a misdemeanor count of continuing to employ illegals after ICE notified him to correct the problem, according to ICE agents.
According to the ICE charging documents, Eberly knew that a number of the furniture company's workers were not unauthorized for employment and continued to keep them on the payroll.
ICE says, Eberly has agreed to pay a $5,000 fine, and also faces a maximum sentence of six months in prison for his role in hiring and retaining illegal immigrants.
There is no word yet what ICE will do with the 18 employees who also continued to work knowing there were federal investigations into their legal status.

Feds file another lawsuit against Arizona over requiring "green cards" for jobs
In an effort to undermine Arizona’s illegal immigration laws once again President Obama’s Administration through the Justice Department filed a suit against the state’s practice of asking for green cards before they hire immigrants for jobs.
The Justice Department claims that a network of community colleges acted in an illegal manner by requiring noncitizens to provide their green cards before they could begin their employment.
The lawsuit against the Phoenix metro area Maricopa Community Colleges slams the state with yet another distraction while Governor Jan Brewer runs for reelection and tries to get the economy turned around for its residents.
The Justice Department is also investigating America’s toughest Sheriff; Joe Arpaio who has continued his campaign against illegal immigration raids after a refined SB1070 became Arizona law.
According to The Washington Post, the newest lawsuit finds, Justice Officials accused Arizona community colleges discriminated against nearly 250 noncitizen job applicants by mandating that they fill out more documents than required by law to prove their eligibility to work. The Department said this violated the federal Immigration and Nationality Act.
The law's anti-discrimination provisions "makes it unlawful to treat authorized workers differently during the hiring process based on their citizenship status," said Thomas E. Perez, assistant attorney general for Justice's Civil Rights Division. He said the government "is acting now to remedy this pattern or practice of discrimination."
The I-9 Immigration form itself recites that "It is illegal to discriminate against any individual (other than an alien not authorized to work in the United States) in hiring, discharging, etc."
A review of the combination of documents from which the employee may choose places the employer in a clear paradox, since none of the documents in the allowed combination prove the employee's right to work in the United States, but the employer is required to attest "that to the best of my knowledge the employee is authorized to work in the United States," says one legal expert.
The mystery of the employee's right to work in the United States could be resolved simply and easily by having the employee present the "green card" which establishes the right of the employee to work or not in the United States.
Currently employers are subjected to fines and imprisonment for hiring employees who are not authorized to work in the United States (ICE raids), but their options to verify the legal status of the prospective employee is hindered by a "smoke and mirrors" instruction that elicits responsibility but withholds the means.
The Federal government has been operating the "E-Verify" system for some time, which provides a quick determination of the prospective employee's right to work in the United States.
"Through E-Verify, U.S. law requires companies to employ only individuals who may legally work in the United States – either U.S. citizens, or foreign citizens who have the necessary authorization.”
This diverse workforce can contribute to the vibrancy and strength of our economy, but that same strength also attracts unauthorized employment by not having a universal worker identification number.
The newest lawsuit in Arizona was filed on behalf of Zainul Singaporewalla, a U.S. permanent resident who was offered a math teaching job at the Glendale Community College, but was asked to fill out another form with current immigration status, the lawsuit explained.
That special form required more documents and a copy of a green card. When the potential employee couldn't find the green card, the suit said, the college would not let Singaporewalla work.
The federal government is asking the judge within the Justice Department unit to make the Maricopa colleges to pay a civil penalty of $1,100 for each of the 247 non-U.S.-citizen job applicants it says were requested to provide additional paperwork.
The Maricopa Community Colleges staff declined to comment on the new lawsuit.

Arizona's new illegal immigration law finds favor in state and nationwide
Arizona’s new illegal immigration law finds favor in the state as well as nationwide, according to a new Rasmussen Poll out this week. While the new law draws the ire of President Obama and the open borders, amnesty crowd on the left, the vast majority of Americans agree with the new legislation to help combat illegal immigration.
Rasmussen points out that 70 percent of Arizonians approve of enforcing the illegal immigration problem that is overwhelming the state. The same poll found 60 percent of American’s throughout the country also favor Arizona new law and say Washington D.C. is falling down on the job when it comes to securing the nation’s borders. The poll also found that only 31 percent of voters are against the new law nationwide.
While the numbers favor the new law, 58 percent say there is a possibility of some American citizen civil rights may be violated in an effort to curtail illegal immigration.
Reports also point to Arizona’s dubious title of kidnapping capitol of the U.S. -currently Mexico City, Mexico hold the top spot.
Phoenix, Arizona’s population consists of 1.4 million and last year’s crime log came in at 90,000. On the other hand New York City’s population is 8.3 million and the crime log read 104,000. Both states had similar crime rates, yet New York City is much larger than Phoenix. Many lawmakers and law enforcement officers attribute the high crime levels to the extensive illegal immigrant population.
It is this very crime that has driven the folks in Arizona to take over where the federal government has failed.
The following is two different opinions as to what Arizona’s fate should be. One is from an Illinois Congressman Luis Gutierrez (D-IL) and the other point of view is from an Arizona/Mexico border resident, Al Garza who is Hispanic. Their take on the illegal immigration problem that plagues Arizona are very different.
A word from a politician and a resident
According to a post from the Huffington Post, Congressman Gutierrez recently went on the record regarding Arizona’s new law.
“It is open season on the Latino community in Arizona. In Phoenix, Tucson, and across the state, people in Latino neighborhoods are afraid to leave their houses, afraid to be apart from their children for even a minute, and afraid to walk the streets because they feel their arrest on suspicion of being an undocumented immigrant could happen at any moment. It is a horrifying glimpse at what our future holds across the country if we continue down the path the Obama administration is leading us on immigration,” said the Congressman.
Douglas, Arizona resident Al Garza, sees it differently. “Luis Gutierrez is Mexico’s number one reconquista agent, the congressional representative from the 4th district in Chicago, thinks he knows what's best for Arizona. If Chicago politician Gutierrez wants to meddle in local Arizona politics, ask him to move to Douglas, Arizona, to see if he can make enough "Chicago style" friends to get elected. We've alerted you about him before. He is one of the reasons that our Republic is no longer being governed in the best interests of its citizens.”
Congressman Gutierrez continues; “This week, we saw how destructive things are getting. The combination of a harsh piece of anti-immigrant legislation advancing in the Arizona legislature and a massive, well-publicized federal enforcement action against a broad human smuggling network has sent the unmistakable message to Arizona's one million immigrants and two million Hispanics: there is a target on your backs and authorities are coming after you.”
Garza takes exception with this point; “I’m Hispanic and I’ve served my country proudly in Vietnam and I can tell you I’ve never been pulled over because I’m brown. I’ve been pulled over for speeding and presented my drivers license and had no problems. Our state is under siege and we need to do something to turn this around before it’s too late.”
Gutierrez contends Arizona’s new law “throws in a bounty of $500 in fines and a possible misdemeanor conviction on criminal trespassing if the particular lawman involved happens to guess correctly and the person they arrest cannot prove they are here legally.”
However, Arizona is hopeful the new law will act as a deterrent for illegal immigrants not to settle in the state and add to the government doles. Like California, Arizona’s budget is overstretched and cuts to services is looming. Governor Brewer says the schools; hospitals and jails are at risk. She has even sent a bill to the federal government for $1 billion to cover the already burdened state.
After several attempts to communicate with Washington D.C. Arizona has yet to hear back from Department of Homeland Security, Janet Napolitano or the White House.
Many residents and lawmakers are not concerned with the ability of law enforcement to do their job.
“As we know from experience in Arizona and elsewhere, giving police such a broad mandate to arrest and book people ‘suspected’ of looking a certain way isn't just an invitation to racial profiling, it's like waving a green flag and saying ‘gentlemen start your engines.’ It is an insult to American justice and one of the harshest assaults on basic civil rights in recent American history,” Gutierrez said.
“After years of Sheriff Joe Arpaio's Latino neighborhood sweeps, harsher and harsher state laws that target Latinos and immigrants, and escalating federal deportation, I'm afraid we have turned a very dangerous corner in the war on immigrants,” he said.
However America’s toughest Sheriff continues to win reelections in a landslide fashion.
Garza finds the statements put forward by the Congressman from Illinois unacceptable. “Chicago Gutierrez's foul technique is nothing new. This time, however, Chicago Luis Gutierrez is attempting to expand the tentacles of influence over the good citizens of Arizona. Like other politicians and groups that support illegal aliens, open borders and, in some cases, reconquista, he attempts to group all people with Latino backgrounds in one group. Legal and patriotic Arizona citizens support (SB 1070). Those who he describes as living in fear and afraid to leave their houses do not support (SB 1070) because they are in this country illegally. Note, Chicago Luis uses the word "houses" and not homes. That's because their homes are elsewhere in foreign lands.”
After the Washington Post published, “internal memos from Homeland Security headquarters to their field agents instructing them that their job performance would be judged by filling deportation quotas for simple visa and immigration violations, all of the President's lofty promises about a new approach went out the window,” Gutierrez writes. “At a minimum, the President has failed to put his heart into reforming immigration. He has dropped the ball in the first year of his presidency and as we head into election season in his second year, we are seeing more of the same.”
Arizona is the state most affected by illegal alien criminal behavior Garza contends, “Chicago Luis wishes to paint the deported alien and the criminals who live among us as the victims in a bizarre attempt to pander to La Raza and similar groups. Would he allow the drug dealers, kidnappers, human smugglers and illegal foreign criminals to continue their activities in his neighborhood and in view of his children and their playmates? This what he wants Arizonans to continue to live with.”
Garza is Hispanic and his only concern is that he may be attacked by “montoneros covardes, better known as illegal alien thugs. If I defend myself against their attacks, and trust me, defend myself I will, I will be accused of victimizing those poor innocent hard workers. I certainly have no fear of wandering throughout my neighborhood or anywhere I choose. No one has ever stopped me for being brown.”
During the 2008 election campaign candidate Obama promised the Latino community amnesty was on the way if they voted for him.
They did. However Obama’s immigration overhaul has turned out to be another empty promise to Hispanics.
“The President knows what we must do, but he alone must summon the political will in Washington to do it. The short-run calculations of politics are deeply rooted and hard to overcome, but as we saw in the health care debate, he can do it if he wants to,” Gutierrez claims. “He needs to stop appeasing those who embrace the persistent fantasy of mass deportation or the delusion that by making America so hostile and uninviting, tens of millions of immigrants will deport themselves. Obama the President needs to stand up for what Obama the candidate and what Obama the Senator and what Obama the Chicago community organizer stood for and lead the Congress towards reform.”
Gutierrez admits that Washington may have waited too long to negotiate the immigration battle zone because midterm elections are looming.
“But I'm already afraid that for the people of Arizona, he has waited too long. Even if an immigration reform bill passed tomorrow, Latino families in Arizona still face the prospect of going out into a hostile world next week,” Gutierrez explains. “I know thousands of Latino families will hesitate before dropping their kids off at school or will have that terrifying twinge of fear before venturing out to buy groceries or go to work. If we allow police-state tactics in Arizona to continue, the level of basic community security will erode and civil unrest could escalate. The President must act now to diffuse the Arizona panic and take control of a deteriorating situation that could become a national crisis.”
Garza sums it up this way. “You've been reading for the last few years about the illegal activities of many Chicago politicians. Chicago Luis Gutierrez's latest demands coming from Chicago, attempting to influence the internal Arizona affairs, demonstrate the new liberal ‘November fear syndrome’ and will not end with Arizona. Chicago Luis and his type of politician, who pander to criminals and ethno-centric outfits, always crawl back between the cracks in the congressional baseboards when the light comes on. We intend to provide that illumination.”
Everyone agrees racial profiling leads to hurt feelings, but when Americans travel to Europe and stay in a hotel, they are asked for their passports upon check in. Many of these hotels will keep the passports during their entire stay, where is the cry of Nazi Germany tactics Europe is practicing?
Arizona’s plight needs to be addressed by all involved and hopefully cooler heads will prevail and Americans will come out the winner. Most agree a good place to start is to secure the country’s borders.

Chicago Luis Gutierrez's latest demands coming from Chicago, attempting to influence the internal Arizona affairs, demonstrate the new liberal ‘November fear syndrome’ and will not end with Arizona. Chicago Luis and his type of politician, who pander to criminals and ethno-centric outfits, always crawl back between the cracks in the congressional baseboards when the light comes on. We intend to provide that illumination.”
Everyone agrees racial profiling leads to hurt feelings, but when Americans travel to Europe and stay in a hotel, they are asked for their passports upon check in. Many of these hotels will keep the passports during their entire stay, where is the cry of Nazi Germany tactics Europe is practicing?
Arizona’s plight needs to be addressed by all involved and hopefully cooler heads will prevail and Americans will come out the winner. Most agree a good place to start is to secure the country’s borders.

Health care debate dampens push for amnesty
“March for America” took place on Sunday, March 21, at Washington D.C.’s National Mall and it drew tens of thousands of activists from across the country rallying for amnesty.
They carried banners from their home countries and signs reading, “You need us as much as we need you,” and “No human being can be Illegal.”
Due to the pressure from the health care reform debate Obama did not attend Sunday’s demonstration. However he did record a message of reassurance to the illegal immigrants and their supporters that appeared on jumbo televisions. The jest of the recorded message was that he would fix the “broken immigration system.”
Among the speakers at the pro-amnesty rally was Rev. Samuel Rodriguez, leader of the National Hispanic Christian Leadership Conference, he compared the Latino amnesty quest to the civil rights movement and said, “This is our Selma.”
The Sunday rally in the country’s capitol allowed amnesty advocates to send a clear message that they won’t excuse any delays on revamping the “comprehensive” immigration system and they threatened leaders in Washington they would vote accordingly in the November midterm elections.
It’s worth pointing out that many of the Latino rally participants reside in this country illegally and are not eligible to vote.
The rally took place days after Senators Chuck Schumer (D-N.Y.) and Lindsey Graham (R-S.C.) announced an outline for a comprehensive immigration reform bill. The three-page blueprint included a controversial mass amnesty provision; create a national biometric ID tamper-proof card and a guest worker program.
Even though the legislation was drawn up in a bipartisan fashion, Graham warned that the bill would receive little support from Republicans if health care reform were passed. Graham suggested if the White House muscled through health care, “immigration reform will be dead.”
However, many illegals are tired of living in the shadows. Rosy Medina boarded a bus in Dallas that would tack her to Washington, DC, to participate in the pro-amnesty rally. ”We live in uneasiness, with panic, without power to buy a house, without licenses to drive,” said Medina, a Mexican illegal alien who, has lived in the country illegally for eight years.
“We are going to be the voice of millions who only want to be given the same opportunities of everyone, that they be allowed to work and that they not be persecuted,” said Rosa Maria Ramos, a resident of Brownsville, Texas, who emigrated 17 years ago from Mexico.
Liberal Failure Demonstrates California’s Economy is Heading Over a Cliff
Nowhere has the throngs of illegal immigrants been felt than California. The state leads the way for immigrants to set up their casa. The massive illegal problem has resulted in a state with huge budget crisis and higher-than-average unemployment numbers.
In 2009, there were an estimated 2.6 million illegal immigrants – nearly a quarter of America’s total illegal immigrant population – residing in California.
“With our state budget in tatters, millions of Californians out of work, failing schools and a state prison system strained by massive overcrowding, California simply cannot continue to ignore the toll that illegal immigration takes on our budget and economy,” says Steve Poizner a Republican Gubernatorial candidate.
“Steve Poizner is willing to take bold steps in order to stop illegal immigration, while Meg Whitman (also a Republican) wants to continue with the status quo. Ten states have passed laws restricting benefits to illegal immigrants and as governor, Poizner will ensure that California does the same,” said Communications Director Jarrod Agen. “The differences in the Republican primary are clear - Steve is proposing bold reforms to turn off the magnets which draw illegal immigrants to California, while Meg Whitman advocates for amnesty.”
However, a recent Field Poll in California has Meg Whitman with a commanding lead in the Republican gubernatorial primary. Even if Poizner were to claim all the undecided voters he would be shy of the votes necessary to earn a bid to play ball with Democrat Jerry Brown the left’s frontrunner.
Whitman claims the lion share of most likely voters 63 percent, while Poizner captured 14 percent with 23 percent undecided. In a head-to-head with Brown, the EBay executive Whitman edges out the Democrat.
However Poizner camp is convinced his position on illegal immigration will resonate with the voters especially after the embattled health care fight. The Latino caucus has pushed the President to take on comprehensive immigration reform this year or face the consequences at the polls in November, according to pro-amnesty activists.
If elected governor, Poizner will advocate for the following policies; cutting taxpayer-funded benefits to illegal immigrants, holding employers responsible for following the law, ending sanctuary city practices and securing our borders.
One thing is certain, after a bitter health care battle most agree the country is not in a position to take on another contentious issue.
